TERMS & CONDITIONS OF SERVICE
Effective Date: September 19, 2009
These Terms & Conditions apply to all shipments tendered to SenCargo on or after the Effective Date.
By tendering goods to SenCargo Services LLC (“SenCargo,” “we,” “our,” or “Company”), the Customer agrees to the following Terms & Conditions. These terms govern all transportation, consolidation, handling, storage, and related services.
ACCEPTANCE OF SHIPMENT
Upon arrival of any package at a SenCargo warehouse or pickup location, the Customer authorizes SenCargo to transport and process the shipment, regardless of whether a formal booking or shipping order has been completed. We reserve the right to refuse any shipment deemed unsafe, improperly packaged, prohibited, or non-compliant with regulations.
CONSOLIDATION & IRREVERSIBILITY OF SHIPMENT
For consolidated shipments, once SenCargo has collected or received the shipment and it has entered our consolidation process, the shipment cannot be rerouted, modified, canceled, or turned around. No changes of any kind are permitted while the shipment is in transit or awaiting vessel departure.
Once the shipment arrives at its destination and is released, the Customer may take possession and arrange any changes independently.
PAYMENT TERMS
All prices are final and non-negotiable. Full payment is required before shipment loading.
SenCargo reserves the right to hold any shipment if payment is not received by the loading date.
If any payment is returned unpaid, a return payment fee will be assessed. The shipment will remain on hold until payment is resolved in full.
STORAGE & COLLECTION POLICY
Shipments must be collected within 10 calendar days of customs release or warehouse availability notification.
After this period, a storage fee of $5 per day per item will apply. SenCargo reserves the right to take appropriate action, including additional storage or disposal procedures, for uncollected shipments.
PACKAGING & CONDITION OF GOODS
Customers are solely responsible for proper packaging and labeling of all goods. SenCargo transports shipments in the exact condition received and does not inspect contents for quality, condition, or completeness.
SenCargo is not responsible for damages resulting from insufficient packaging or inherent defects.
DECLARATION & CUSTOMS COMPLIANCE
Customers must provide a complete and accurate inventory/packing list for customs purposes.
Undervaluation, misdeclaration, or failure to declare contents may result in fines, seizure, delays, or legal penalties. The Customer remains fully liable for all resulting costs, damages, and consequences.
Commercial items must be declared during reservation and may incur additional customs fees.
Customs fees are included in standard rates except for vehicles.
LIABILITY & INSURANCE
Sencargo is strictly a transportation intermediary and shall not be liable for loss, damage, delay, or non-delivery caused by ocean freight operations, weather, port conditions, customs delays, vessel issues, strikes, or other circumstances beyond our control.
Customers are strongly advised to obtain marine cargo insurance.
SHIPPING SCHEDULES
Shipments are dispatched from the ort of New York / New Jersey at the first available opportunity. If space limitations occur or shipments arrive too late for loading, SenCargo may defer shipment to the next available container.
Transit dates are estimates only and not guaranteed.
Once a shipment leaves the country of origin, it cannot be stopped or returned until it reaches destination.
CANCELLATIONS
If a Customer cancels a shipment after collection or provides less than 72 business hours notice, the Customer remains responsible for all costs incurred.
DELIVERY & PICKUP OPTIONS
Shipments may be delivered within Dakar for an additional fee or picked up at the SenCargo warehouse in Hann Maristes.
AML / KYC COMPLIANCE
SenCargo complies with Anti-Money Laundering (AML), sanctions, and Know Your Customer (KYC) regulations. We may conduct identity verification, background checks, and transaction monitoring as required by law.
PROHIBITED ITEMS
The Customer agrees not to ship prohibited or restricted items, including but not limited to:
• Alcoholic beverages
• Firearms, ammunition, explosives
• Perishable food or refrigerated goods
• Hazardous materials or dangerous goods
• Narcotics or illegal substances
• Live animals or biological materials
• Currency or negotiable instruments
• Pornographic materials
• Ivory or endangered species products
• Plants or agricultural materials
• Lithium batteries and regulated chemicals
• Any item requiring special licensing
• Any shipment prohibited by law
Wet, leaking, odorous, or unsafe packages will be refused.
SenCargo is not liable for prohibited shipments and reserves the right to report violations. The Customer agrees to indemnify SenCargo for all resulting penalties, fees, or damages.
SERVICE LIMITATIONS
SenCargo transports used household goods unless otherwise declared. Special handling or commercial shipments require prior approval.
We do not guarantee schedules or transit timelines due to external factors beyond our control.
SERVICE MODIFICATIONS
SenCargo may update or modify these Terms at any time. Updated terms become effective upon posting. Continued use of services constitutes acceptance.
CUSTOMER RESPONSIBILITY
The Customer agrees to comply with all applicable laws and regulations. Any violation remains solely the Customer’s responsibility.
